What is CBD Mandatory Disclosure?
Commercial Building Disclosure (CBD) is a national program designed to improve the energy efficiency of Australia’s large office buildings.
When does it commence?
Disclosure obligations commence with a transition period from November 1st, 2010. Only NABERS Energy ratings are to be disclosed.
Who will be required to act?
Most sellers or lessors of office space of 2,000 square metres or more will be required to obtain and disclose an up-to-date energy efficiency rating.
What will I need to know?
Transition Period
For the first 12 months of the program, a VALID National Australian Built Environment Rating System (NABERS) base building or whole building energy rating can be disclosed.
Process after the first 12 months
From 1 November 2011, a full Building Energy Efficiency Certificate (BEEC) will need to be disclosed. BEECs are valid for 12 months, must be publicly accessible on the online Building Energy Efficiency Register, and include:
- a NABERS energy star rating for the building
- an assessment of tenancy lighting in the area of the building that is being sold or leased and
- general energy efficiency guidance
The NABERS energy star rating must also be included in any advertisement for the sale, lease or sublease of the office space.
The CBD program has been developed by the Australian, state and territory governments, as part of a broad package of measures to encourage building energy efficiency. The program is managed by the Australian Government Department of Climate Change and Energy Efficiency.
What do I need to do?
In order to meet the Act requirements, a NABERS energy rating must:
- be obtained either before or during the transition period
- be a base building or whole building rating
- be current (i.e. the validity period stated on the NABERS energy rating must not have expired) and
- be publicly accessible on the CBD program website, or
- From 1 November 2011, a full Building Energy Efficiency Certificate (BEEC) will need to be disclosed and must be publicly accessible on the Building Energy Efficiency Register.
What data do I need for a NABERS Energy Rating?
- The net lettable area ( preferably to PCA 1997 Measurement Standards)
- 12 months of consecutive energy bills (all energy sources)
- Street address and postcode of the premises to be rated
- Lease terms and conditions
- Number of occupants/computers/hours of occupancy
